CLOSING PROCESS AND COSTS

We have chosen to list our home For Sale By Owner (FSBO) to avoid realtor fees and to list the home at a price that we feel is fair to both the buyer and the seller. Accordingly, we are unable to pay any buyer real estate agent commissions out of the sales price.
Prospective buyers are invited to contact the seller to schedule a tour of the home. The seller requests a minimum of 48 hours advance notice, if possible, but will attempt to accommodate shorter notice periods.
The seller requests that all offers to purchase the home be submitted in writing and include the following:
1. The identity of the buyer(s); 2. Proposed purchase price; 3. Proposed earnest money amount; 4. Proposed closing date; 5. Financing details (cash or mortgage type); 6. All buyer contingencies; 7. Buyer's proposed inclusions and exclusions; 8. Any non-fixture furnishings desired by the prospective buyer; 9. The deadline for seller to respond to the offer; and 10. Confirmation that the seller is not obligated to pay buyer real estate agent commissions.
Once an offer is accepted, the buyer and seller will promptly negotiate and execute a Contract to Buy and Sell Real Estate (Residential) in a form approved by the Colorado Real Estate Commission, with the seller providing the first draft. This contract will be binding on the parties and will contain all material terms of the purchase and sale, including the purchase price, the earnest money deposit amount, and the negotiated deadlines for closing and pre-closing activities.
The seller will provide a standard special warranty deed to the buyer(s) at closing.
The seller is flexible on the closing date but would prefer a minimum of 45 days after execution of the sales contract.
The seller proposes to engage a title company familiar with FSBO closings to provide earnest money escrow services, closing services and title insurance, with the buyer and seller sharing the closing costs in accordance with customary practices.
